4708 sayılı yapı denetimi hakkında kanun kapsamındaki yapı denetimi sistemi ve sorunları üzerine bir saha çalışması, Osmaniye ili örneği

Abstract

Ülkemizde, 1999 yılında yaşanan Marmara depreminden sonra, Devletimiz gerekli çalışmaları başlatmış ve yapı denetimi sisteminde köklü bir değişikliğe gitmiştir. Yapılarda güvenirliliği ve yasal mevzuata göre denetimi sağlamak amacıyla; 13 Temmuz 2001 tarihli Resmi Gazetede 4708 sayılı Yapı Denetimi Kanunu ve bu kanuna dayalı Yapı Denetimi Uygulama ve Esasları Yönetmeliği yürürlüğe sokulmuştur. Bu tarihten itibaren kanun ve yönetmelik 19 pilot ilde, daha sonra 01 Ocak 2011 tarihinden itiabren de tüm ülke genelinde uygulanmaya başlanmıştır. Bu tez çalışmasında; 4708 Sayılı Yapı Denetimi Kanunu ve Yapı Denetimi Uygulama Yönetmeliği ile sınırları çizilen yapı denetim sisteminin, uygulamasında kullanılan yasal mevzuat kapsayıcı şekilde değerlendirilmiştir. Yapı denetim sistemi ve tarihi incelenmiş, yabancı ülkelerdeki yapı denetim sistemi üzerinde durulmuş, Türkiye'deki mevcut yapı denetim sistemi hakkında bilgi verilmiş ve Osmaniye ilinde bulunan yapı denetim firmalarının, belediyelerin ve Çevre Şehircilik ve İklim Değişikliği il Müdürlüğünün görüş ve düşünceleri alınmış ve kapsamlı bir değerlendirme yapılmıştır.After the 1999 Marmara earthquake in our country, our State initiated the necessary studies and made a radical change in the building inspection system. In order to ensure reliability in buildings and control according to legal regulations; In the Official Gazette dated 13 July 2001, the Building Inspection Law No. 4708 and the Building Inspection Practices and Principles Regulation based on this law was put into effect. As of this date, laws and regulations have been implemented in 19 pilot provinces, and then, from 01 January 2011, throughout the country. In this thesis study; The legal legislation used in the implementation of the building inspection system, the boundaries of which were drawn with the building inspection law numbered 4708 and the construction inspection implementation regulation, were evaluated comprehensively. The building inspection system and its history were examined, the building inspection system in foreign countries was emphasized, information was given about the existing building inspection system in Turkey, and the views and opinions of the building inspection companies, municipalities and the Provincial Directorate of Environment, Urbanization and Climate Change in Osmaniye were taken and a comprehensive evaluation was made.
